If we hire a bondsman to help get someone out of jail, and they die before their case is heard, will our money be refunded?
The fee you pay to a bondsman is non refundable and is charged for the service they provide. It is something that is earned by them at the time the defendant gets out of jail.
When someone is arrested by a member of the Orinda Police Department the fastest way to get them released from custody is to pay cash bail or hire a local bondsman. For the first option friends and/or family members would need to gather the defendant’s full bail amount in cash. They would then take that money and post it at the jail. The court will hold onto it for the duration of the case. If the defendant appears for all their court dates, the money will be refunded once the case is over. Most people do no have ready access to very large sums of money. This is where an expert bondsman comes in.
For a 10% fee, the bondsman in Orinda will post a piece of paper at the jail called a bail bond. It promises the defendant will come back and go to court if they are released pending trial. If they do not, the bondsman will need to get them back into the system within six months. Should they fail, they will be on the hook to pay the full bail amount as a penalty. Bail agents take on liability each time a bond is posted which is why a non-refundable fee is charged for this service.
